Terms of Service

The rules governing your use of the Teka platform. Please read these carefully before using Teka.

1. Acceptance of Terms

By downloading, installing, or using the Teka mobile application ("App") or accessing the Teka website at teka-mh.co.za ("Website"), you ("User", "Creator", "you") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, our Community Guidelines, and our Copyright Policy.

If you do not agree to these Terms, you must not use Teka. We reserve the right to update these Terms at any time. Continued use of Teka after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years of age to register an account or access any features of Teka. We require age verification (government-issued ID) during the sign-up process to confirm your eligibility.

By creating an account, you confirm that:

  • You are 18 years of age or older
  • You have not previously been suspended or permanently banned from Teka
  • Your use of Teka does not violate any applicable law or regulation in your jurisdiction
  • You have the legal capacity to enter into a binding agreement
Zero Tolerance: Any attempt to circumvent age verification, or use of the platform by anyone under 18, will result in immediate permanent account termination and referral to appropriate authorities where required by law.

3. Account Registration and Security

To use Teka, you must create an account with a valid email address and complete age verification. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorised use of your account at support@teka-mh.co.za
  • Keeping your profile information accurate and up to date

You may not create more than one account without our express written permission. Multiple accounts used to circumvent bans or earn referral income fraudulently will all be terminated.

4. Content and Intellectual Property

4.1 Your Content

You retain full ownership of all original content you create and upload to Teka ("Your Content"). By uploading content, you grant Teka a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to host, store, reproduce, modify (for formatting/display purposes), distribute, and display Your Content solely for the purpose of operating and providing the Teka platform.

This licence ends when you delete content or your account is permanently deleted (subject to a 30-day grace period).

4.2 Your Representations

By uploading content, you represent and warrant that:

  • You own or have the necessary rights and licences to upload and share the content
  • The content does not infringe any third party's intellectual property, privacy, or other rights
  • The content complies with our Community Guidelines and Copyright Policy
  • You have the right to declare the audio source (original, royalty-free, licensed) when uploading

4.3 Teka's Intellectual Property

All rights in the Teka platform, including software, logos, trademarks, designs, and any Teka-created content, are owned exclusively by Teka SA (Pty) Ltd. You may not copy, reproduce, distribute, or create derivative works of any Teka intellectual property without our express written consent.

5. Creator Earnings Programme

5.1 Revenue Share

Teka shares 50-60% of net ad revenue (revenue collected by Teka via Google AdMob after Google's fees) with creators whose content generates ad views. The exact percentage may vary based on ad format, viewer location, and other factors, but will always fall within the 50-60% range.

5.2 Earnings Eligibility

Earnings are available from your first video upload. There is no minimum follower count, no waiting period, and no application process required to start earning.

5.3 Withdrawals

  • Minimum withdrawal threshold: as stated in-app (subject to change with notice)
  • Withdrawals are processed via Paystack or other supported payment methods available in your region
  • Processing times vary by payment method (typically 1-7 business days)
  • Teka is not responsible for payment delays caused by third-party payment processors

5.4 Earnings Forfeiture

Important: Any earnings in your account at the time of account deletion will be forfeited if not withdrawn before the 30-day grace period expires. Videos removed for Community Guidelines violations or copyright infringement will have their associated earnings voided.

5.5 Tax Obligations

Creator earnings may constitute taxable income in your jurisdiction. You are solely responsible for determining, reporting, and paying any taxes applicable to your earnings from Teka. We may request tax information as required by law and may be required to report earnings to tax authorities.

6. Referral Programme

Teka operates a tiered referral programme where you can earn a percentage of the platform's revenue share (not the creator's share) from creators you refer:

Referral bonuses are paid from Teka's portion of ad revenue — they do not reduce the referred creator's earnings. Fraudulent referrals (e.g., creating fake accounts, self-referral) will result in forfeiture of all referral earnings and account termination.

7. Prohibited Content and Conduct

The following are strictly prohibited on Teka. Violations may result in immediate account termination:

  • Child Sexual Abuse Material (CSAM): Any sexual content involving minors — zero tolerance, reported to NCMEC and relevant law enforcement
  • Hate speech: Content that promotes hatred, violence, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
  • Graphic violence: Content depicting extreme violence, gore, or real-world harm without educational or journalistic context
  • Harassment and threats: Content designed to intimidate, threaten, or harass specific individuals
  • Misinformation: Demonstrably false information that could cause real-world harm
  • Spam: Artificially inflating views, likes, followers, or earnings through bots or coordinated inauthentic behaviour
  • Copyright infringement: Using copyrighted material without a licence — see our Copyright Policy
  • Impersonation: Impersonating another person, creator, or entity in a misleading way
  • Illegal activity: Content that promotes, facilitates, or depicts illegal activities
  • Malware / phishing: Links or content designed to harm, deceive, or compromise users' devices or accounts
  • Non-consensual intimate content: Sharing intimate images or videos without the subject's consent

8. Copyright and DMCA / Copyright Act Notices

We respect intellectual property rights. If you believe content on Teka infringes your copyright, please send a notice to support@teka-mh.co.za with:

  • Identification of the copyrighted work claimed to be infringed
  • Identification of the infringing content and its location on Teka
  • Your contact information (name, address, email)
  • A statement that you have a good faith belief the use is not authorised by the copyright owner
  • A statement, under penalty of perjury, that the information is accurate and you are the copyright owner or authorised agent
  • Your physical or electronic signature

We will review and respond to valid copyright notices promptly. See our Copyright Policy for full details.

9. Account Suspension and Termination

We may suspend or terminate your account, at our discretion, for:

  • Violation of these Terms, Community Guidelines, Copyright Policy, or Privacy Policy
  • Fraudulent activity (fake views, referral fraud, payment fraud)
  • Providing false information during registration or age verification
  • Actions that harm other users or the platform's integrity
  • Any other reason we deem necessary to protect the platform and its users

You may also terminate your account at any time via Settings → Account Settings → Delete Account. See our Account Deletion Policy for details on the 30-day grace period.

10. Disclaimers and Limitation of Liability

TEKA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TEKA SA (PTY) LTD AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, revenue, or goodwill
  • Interruption to or unavailability of the platform
  • Any third-party content posted by users on the platform
  • Delays or failures in payment processing caused by third-party payment providers

In no event shall Teka's total aggregate liability exceed the greater of R500 (five hundred rand) or the total fees paid by you to Teka in the 12 months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Teka SA (Pty) Ltd and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of Teka; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third party's rights.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of Teka shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be referred to the courts of competent jurisdiction in Johannesburg, South Africa, and you consent to the exclusive jurisdiction of those courts.

Nothing in this clause prevents us from seeking urgent injunctive relief in any jurisdiction.

13. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy, Community Guidelines, and Copyright Policy, constitute the entire agreement between you and Teka regarding the platform.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
  • No Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
  • Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
  • Notices: We may notify you via in-app notification or email. You may notify us via email at support@teka-mh.co.za.
